In Poor Whites of the Antebellum South, Charles C. Bolton gives a distinct voice to one of the most elusive groups in the society of the Old South. Bolton's detailed examination reveals much about the lives of these landless white tenants and laborers and their relationship to yeoman farmers, black slaves, free blacks and elite whites. Providing a provocative analysis of the failure of the Jeffersonian "yeoman ideal" of democracy in white-majority areas, this book also shows how poor whites represented a more significant presence on the political, economic, and social landscape than previously had been thought.
Looking at two specific regions--the "settled" central piedmont of North Carolina and the "frontier" of northeast Mississippi--Bolton describes how poor whites played an important, though circumscribed, role in the local economy. Dependent on temporary employment, they represented a troubling presence in a society based on the principles of white independence and black slavery. Although perceived by southern leaders as a threat, poor whites, Bolton argues, did not form a political alliance with either free or enslaved blacks because of numerous factors including white racism, kinship ties, religion, education, and mobility. A concluding discussion of the crisis of 1860-61 examines the rejection of secession by significant numbers of poor whites, as well as the implications for their future as the Old South turned toward the new.

In 1836 Benjamin Drake, a midwestern writer of popular sketches for newspapers of the day, introduced his readers to a new and distinctly American rascal who rode the steamboats up and down the Mississippi and other western waterways--the riverboat gambler. These men, he recorded, "dress with taste and elegance; carry gold chronometers in their pockets; and swear with the most genteel precision. . . . In Blacklegs, Card Sharps, and Confidence Men, Thomas Ruys Smith collects nineteenth-century stories, sketches, and book excerpts by a gallery of authors to create a comprehensive collection of writings about the riverboat gambler. In this classic work of Mississippi history, Nollie W. Hickman relates the felling of great forests of longleaf pine in a southern state where lumbering became a mighty industry.Mississippi Harvest records the arduous transportation of logs to the mills, at first by oxcart and water and later by rail. It details how the naval stores trade flourished through the production of turpentine, pitch, and rosin and through the expansion of exports, which furnished France with spars for sailing vessels. The book tracks the impact of the Civil War on southern lumbering, the tragedy of denuded lands, and, finally, the renewal of resources through reforestation.

Born into a family of lumbermen, Hickman acquired firsthand knowledge of forest industries. Later, as a student of history, he devoted years of painstaking work to gathering materials on lumbering. His information comes from many sources including interviews with loggers, rafters, sawmill, and turpentine workers, and company managers, and from company records, land records, diaries, old newspapers, lumber trade journals, and government documents.

While the author's purpose is to share the history of a natural resource, he also gives the reader the panorama of Mississippi. Mississippi Harvest interprets the state's people, agriculture, industry, government, politics, economy, and culture through the lens of one of the state's earliest and most lasting economic engines.

Now Ball revisits that grisly crime to tell how, four decades later, justice finally came to Philadelphia.

Originally tried in 1967, Baptist minister and Klansman Edgar Ray Killen was set free because one juror couldn't bring herself to convict a preacher. Now Ball tells how progressive-minded state officials finally re-opened the case and, forty years after the fact, enabled Mississippians to reconcile with their tragic past.

The second trial of 80-year-old "Preacher" Killen, who was convicted by a unanimous jury, took place in June 2005, with the verdict delivered on the forty-first anniversary of the crime. Ball, himself a former civil rights activist, attended the trial and interviewed most of the participants, as well as local citizens and journalists covering the proceedings.

Ball retraces the cycle of events that led to the resurrection of this "cold case," from the attention generated by the film Mississippi Burning to a new state attorney general's quest for closure. He reviews the strategies of the prosecution and defense and examines the evidence introduced at the trial-as well as evidence that could not be presented-and also relates first-hand accounts of the proceedings, including his unnerving staring contest with Killen himself from only ten feet away.

Ball explores the legal, social, political, and pseudo-religious roots of the crime, including the culture of impunity that shielded from prosecution whites who killed blacks or "outside agitators." He also assesses the transformation in Mississippi's life and politics that allowed such a case to be tried after so long. Indeed, the trial itself was a major catalytic force for change in Mississippi, enabling Mississippians to convey a much more positive national image for their state.

Ball's gripping account illuminates all of this and shows that, despite racism's long stranglehold on the Deep South, redemption is not beyond the grasp of those who envision a more just society.

Governors William F. Winter and Ronnie Musgrove, U.S. Senators Trent Lott and Thad Cochran, and former state Attorney General Michael Moore are all alumni of the School of Law.

The University of Mississippi School of Law: A Sesquicentennial History gives a full overview of the institution's development from its inception in 1854 to 2004. The book examines the school during Reconstruction, its growth from a "law department" into a "law school," the impact of World Wars I and II on its students and faculty, and its transition from a male-only program to a co-educational one.

Author Michael de L. Landon discusses how notable leaders ensured that, despite its problems, the school maintained its high academic standards and its worthy reputation both within its home state and nationally. The book discusses the school's struggles in dealing with racial segregation, as well as periodic confrontations with state political figures. The history examines the school's expansion, basic curriculum, and supplementary programs to show how it achieved a place among the finest law schools.

Michael de L. Landon is professor emeritus of history at the University of Mississippi. His previous books include The Challenge of Service: A History of the Mississippi Bar's Young Lawyers, 1936-1986 and The Honor and Dignity of the Profession: A History of the Mississippi State Bar Association, 1906-1976, among others.

Phaneuf examined the influence of school security practices on student fear, student bonding, and school climate in a sample of secondary schools. Her results indicated that the use of security practices in schools did not influence levels of student fear or bonding. Several school- and community-level variables were better predictors of student fear and bonding than was the use of school security strategies. Among these variables were community poverty and disorganization, the percentage of black teachers, school auspices (public, private, Catholic), community gang problems, and student enrollment.

This book deals with sentencing in international criminal law, focusing on the approach of the UN ad hoc Tribunals for the former Yugoslavia (ICTY) and Rwanda (ICTR). Moreover, international judges receive very little guidance in sentencing matters, which contributes to inconsistencies and may increase the risk that similar cases will be sentenced in different ways. The book investigates and evaluates the process of international sentencing, especially as interpreted by the ICTY and the ICTR, and suggests a more comprehensive and coherent system of guiding principles which will foster the development of a law of sentencing for international criminal justice. It discusses the law and jurisprudence of the ad hoc Tribunals, and also presents an empirical analysis of influential factors and other data from ICTY and ICTR sentencing practice, thus offering quantitative support for the doctrinal analysis. It is one of the first publications to be entirely devoted to the process of sentencing in international criminal justice.

Credit Card Lawsuit - I Don't Want to Go to Court

Many people have a fear of going to court. The judge, the jury, it can be a scary place for someone who doesn't do it every day. Truth be told, however, is that most credit card cases do not require the individual to actually go to court.

The truth of the matter is that many of the credit accounts that go delinquent do not result in immediate lawsuits. What happens in many cases is that the original creditor, whether it is a department store or a financial institution, sells the delinquent account to a collection agency or junk debt buyer. Buying and selling debt is a very large business. The original creditor does this to wash its hands of the bad debt, and the collection agency likes this exchange because it is able to purchase these delinquent accounts at a substantial discount, often for only a few pennies on the dollar. What does this have to do with you going to court on one of these cases? Read on.

Credit card cases are typically what I call "document" cases. The credit card company, or collection agency, needs documents to prevail in court. Most often, they need a card member agreement, terms and conditions, monthly account statements, and if the debt was sold, a copy of the Assignment. (Assignment is a contract between original creditor and purchasing debt collection company). When a debt is sold, at least when it is sold for pennies on the dollar, the documents often are not sold as part of the deal. Most of you are thinking, "That can't be true, can it"? It is the truth. Think about the price of the debt. A collection agency pays pennies on the dollar, how much can they actually get? Often, its just a name, address, phone number, account number, balance, and not much else.

What does this have to do with you going to court? Everything. When a collection agency lawsuit is filed on a credit card account, these documents are often missing from the lawsuit. Your proper response is to hire a consumer attorney to defend your interests. The attorney will file documentation (called Objections in PA where I practice law) that questions the legal sufficiency of the lawsuit. A judge should agree that the lawsuit is insufficient and force the collection agency to come up with the proper documentation. If they are unable to provide this documentation, and this is often the case, then the court ultimately will dismiss the lawsuit. You, personally, never end up in court. It's simply just a matter of your attorney handling the case and forcing the collection agency to provide its evidence or suffer a dismissal.

To be fair, I only practice law in Pennsylvania and can only comment on how these cases play out in PA. In my discussions with other consumer attorney in other states, there are often different procedures that need to be followed to obtain a dismissal on these cases. Fortunately, however, most of these procedures require only the attendance of your attorney in a court of law, not you.

Biological Influences on Criminal Behavior fundamentally questions the way most criminologists attempt to explain, let alone ameliorate the problem of human criminal behavior. Written by Gail Anderson, a highly respected expert in forensics, who also brings a much-needed biological background to the task, this resource champions contemporary biological theory by introducing criminologists to areas of research they might not otherwise encounter.

Dr. Anderson discusses basic biological concepts such as natural selection and evolution in relation to behavior, and considers genetic factors including patterns of inheritance, sex-linked traits, and propensities toward aggression.
